Terms of Service

Please read these Terms of Service ("Terms," "Terms of Service," or "Terms and Conditions") carefully before using the MyEval AI platform and associated services (collectively, the "Service") operated by MyEval AI ("Company," "we," "our," or "us"). These Terms constitute a legally binding agreement between you ("User," "you," or "your") and MyEval AI governing your access to and use of the Service.

1. Acceptance of Terms

By accessing, browsing, or using the Service in any manner — including creating an account, subscribing to a plan, or simply viewing content — you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to all of these Terms, you must not access or use the Service.

You represent and warrant that you are at least 18 years of age (or the age of legal majority in your jurisdiction, whichever is greater) and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms, and references to "you" shall include both you individually and the organization.

2. Description of Services

MyEval AI is an AI-powered health education and information platform designed to help users explore and learn about health topics, wellness indicators, symptom patterns, ICD (International Classification of Diseases) code references, and general health-related risk information. The platform leverages artificial intelligence technology — specifically Claude, developed by Anthropic — to generate educational health content, informational scores, and reference materials.

MyEval AI is not a medical provider, healthcare facility, physician practice, diagnostic laboratory, or clinical service of any kind. We do not employ physicians, nurses, or other licensed clinicians to deliver care through this platform. The Service does not constitute the practice of medicine, nursing, pharmacy, or any other licensed healthcare profession. No aspect of the Service is intended to create, and does not create, a provider–patient or doctor–patient relationship between MyEval AI (or any of its employees, contractors, or affiliates) and any User.

The Service may include, but is not limited to, the following features and functionalities:

• AI-generated educational health information and wellness summaries
• Informational health scores and risk indicators for educational purposes
• ICD code reference matching for informational use
• Symptom-pattern exploration and educational content generation
• General wellness and lifestyle information
• Educational resources about health conditions and terminology

All features are provided strictly for educational and informational purposes. They are not intended to be, and must not be used as, a substitute for professional medical advice, diagnosis, or treatment.

4. AI Content Disclosure

MyEval AI utilizes artificial intelligence technology to generate content displayed on the platform. Specifically, the Service employs Claude, a large language model developed by Anthropic, to produce health-related educational information, scores, summaries, and other textual content.

You should be aware of the following regarding AI-generated content:

• Content is AI-generated. The majority of health information, scores, assessments, recommendations, and written content presented on this platform is generated by artificial intelligence, not written or reviewed by licensed physicians or healthcare professionals on a per-query basis.
• AI may produce inaccurate or incomplete information. Large language models can generate content that appears authoritative but may contain factual errors, outdated information, logical inconsistencies, or "hallucinations" (plausible but fabricated information). You should independently verify any information obtained through the Service before relying on it.
• AI is not a substitute for professional judgment. No AI system, regardless of its sophistication, can replace the clinical judgment of a trained and licensed healthcare professional who can examine you, review your complete medical history, and consider the full context of your health situation.
• AI models evolve over time. The underlying AI models may be updated, changed, or replaced, which could affect the nature, quality, or consistency of the content generated.

California AB 3030 Compliance: In accordance with California Assembly Bill 3030 and applicable state laws regarding AI-generated healthcare communications, we disclose that content generated on this platform is produced by artificial intelligence technology. This AI-generated content has not been individually reviewed, approved, or endorsed by a licensed healthcare provider for your specific use. If your state or jurisdiction has additional AI disclosure requirements, this notice is intended to satisfy those requirements as well.

5. User Accounts

To access certain features of the Service, you must create an account. When creating and maintaining your account, you agree to the following:

• Accurate information. You must provide accurate, current, and complete information during the registration process and keep your account information updated at all times. Providing false, misleading, or outdated information may result in account suspension or termination.
• Account security. You are solely responsible for maintaining the confidentiality of your account credentials, including your password and any authentication tokens. You must not share your login credentials with any third party. You agree to notify us immediately at legal@myeval.ai if you become aware of any unauthorized access to or use of your account.
• Account responsibility. You are fully responsible for all activities that occur under your account, whether or not you have authorized such activities. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
• One account per person. Each User may maintain only one active account. Creating multiple accounts to circumvent limitations, abuse promotions, or evade enforcement actions is prohibited.
• Termination rights. We reserve the right, in our sole discretion, to suspend, deactivate, or permanently terminate your account at any time, with or without notice, for any reason, including but not limited to: violation of these Terms, abusive or fraudulent conduct, extended inactivity, or requests by law enforcement or government agencies. You may also delete your account at any time through your account settings or by contacting us.

6. Subscription and Payment Terms

6.1 Subscription Plans and Billing

MyEval AI offers subscription-based access to premium features. Subscriptions are available on a monthly or annual billing cycle, as indicated at the time of purchase. The specific features, limitations, and pricing for each plan are described on our pricing page and may be updated from time to time.

6.2 Auto-Renewal

Your subscription will automatically renew at the end of each billing period (monthly or annually, as applicable) unless you cancel your subscription before the renewal date. Upon renewal, you will be charged the then-current subscription fee for the applicable plan. It is your responsibility to cancel before the renewal date if you do not wish to continue your subscription. We will send a reminder notification prior to each renewal when required by applicable law.

6.3 Price Changes

We reserve the right to change subscription prices at any time. If we change the price of your subscription, we will provide you with at least 30 days' advance written notice (via email or in-app notification) before the price change takes effect. The new price will apply at the start of your next billing cycle following the notice period. If you do not agree with a price change, you may cancel your subscription before the new price takes effect.

6.4 Cancellation Policy

You may cancel your subscription at any time through your account settings or by contacting our support team. Upon cancellation:

• Your access to premium features will continue through the end of your current billing period.
• No further charges will be applied after the current billing period ends.
• Your account will revert to a free-tier account (if available) or become inactive at the end of the billing period.

6.5 Refund Policy

• Annual plans: If you cancel an annual subscription within the first 30 days of your initial purchase or renewal, you are eligible for a pro-rated refund for the unused portion of your subscription term. After 30 days, no refunds will be issued for annual plans.
• Monthly plans: Monthly subscriptions are non-refundable. You will retain access through the end of the current billing month.
• EU Users — Right of Withdrawal: If you are a consumer located in the European Union, you have the right to withdraw from your subscription within 14 days of purchase without giving any reason, in accordance with the EU Consumer Rights Directive (Directive 2011/83/EU). To exercise this right, you must inform us of your decision to withdraw by sending a clear statement to legal@myeval.ai. If you have already accessed or used the premium Service during the withdrawal period, we may deduct a proportionate amount from the refund for the services already provided.

6.6 Free Trials

We may offer free trial periods for certain subscription plans at our discretion. If you sign up for a free trial:

• No payment details are required, and you will not be charged. Your free trial ends automatically at the end of the trial period, and your account returns to the Free plan.
• To keep the features you used during the trial, you can choose a paid plan at any time. A paid plan starts only when you choose it and agree to its price and terms.
• Free trial eligibility is limited to new subscribers and may be restricted to one trial per User.

6.7 Payment Processing

All payment transactions are processed securely through Stripe, a third-party payment processor. By subscribing to a paid plan, you agree to Stripe's Terms of Service and Privacy Policy. We do not store your full credit card number, debit card number, or bank account information on our servers. All payment data is handled directly by Stripe in compliance with PCI DSS (Payment Card Industry Data Security Standard) requirements.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. Specifically, you agree not to:

• Use the Service for any purpose that is unlawful, fraudulent, or prohibited by these Terms, or that violates any applicable local, state, national, or international law or regulation.
• Rely on the Service for emergency medical decisions or time-critical health situations. The Service is not designed for emergencies. In any emergency, call 911 or your local emergency services immediately.
• Use AI-generated content from the Service as the sole or primary basis for making medical, clinical, or health-related decisions without consulting a qualified healthcare professional.
• Use automated scripts, bots, crawlers, scrapers, or other automated means to access, collect data from, or interact with the Service without our express written permission.
• Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, or underlying models of the Service or any component thereof.
• Attempt to probe, scan, or test the vulnerability of the Service or any related system or network, or breach any security or authentication measures.
• Interfere with or disrupt the integrity, performance, or availability of the Service or its underlying infrastructure.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Resell, redistribute, sublicense, or commercially exploit the Service or any content generated through the Service without our prior written consent.
• Use the Service to generate content that is defamatory, obscene, harassing, or that infringes on the rights of any third party.

We reserve the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates these acceptable use provisions, including reporting such violations to law enforcement authorities.

8. Health Data and Privacy

Your privacy is important to us. Our collection, use, and protection of your personal information, including any health-related data you provide through the Service, is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you acknowledge that you have read and understand our Privacy Policy.

Consent to health data processing. By entering health-related information into the Service (including but not limited to symptoms, health history, lifestyle data, and wellness indicators), you expressly consent to MyEval AI processing this data for the purpose of generating educational health scores, informational assessments, and related educational content. You understand and agree that:

• Health data you provide is used exclusively for educational scoring, informational analysis, and generating educational content within the Service.
• Your health data may be processed by AI systems (including third-party AI providers such as Anthropic) to generate educational content. We require our AI providers to adhere to strict data handling and confidentiality standards.
• We do not sell your personal health data to third parties for marketing or advertising purposes.
• You may request deletion of your health data at any time by contacting us at legal@myeval.ai or through your account settings, subject to any legal retention obligations.

9. Intellectual Property

9.1 Platform Content and Technology

All content, features, functionality, software, code, designs, text, graphics, logos, icons, images, audio, video, data compilations, and the overall look and feel of the Service (collectively, "Platform Content") are the exclusive property of MyEval AI or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

9.2 AI Models and Algorithms

The AI models, algorithms, machine learning systems, scoring methodologies, and related technologies used in the Service are proprietary to MyEval AI and/or our technology partners (including Anthropic). You acknowledge that these technologies constitute valuable trade secrets and confidential information. You shall not attempt to extract, replicate, reverse engineer, or create derivative works based on these technologies.

9.3 User-Generated Content

You retain ownership of any original content you submit to the Service (such as text inputs, health information entries, and feedback). However, by submitting content to the Service, you grant MyEval AI a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, process, adapt, and display such content solely for the purposes of operating, improving, and providing the Service. This license continues even after you stop using the Service, but only with respect to aggregated or de-identified data that does not personally identify you.

9.4 Trademarks

"MyEval AI," "MyEval.AI," the MyEval AI logo, and all related names, logos, product and service names, designs, and slogans are trademarks of MyEval AI or its affiliates. You may not use such marks without our prior written permission. All other names, logos, product and service names, designs, and slogans on the Service are the trademarks of their respective owners.

10. Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MYEVAL AI DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.2 No Liability for Health Outcomes

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MYEVAL AI SHALL NOT BE LIABLE FOR ANY HEALTH OUTCOMES, MEDICAL COMPLICATIONS, INJURIES, OR DAMAGES OF ANY KIND THAT MAY RESULT FROM YOUR USE OF OR RELIANCE ON INFORMATION PROVIDED THROUGH THE SERVICE. THIS INCLUDES, WITHOUT LIMITATION:

• Any adverse health outcomes resulting from reliance on AI-generated content, health scores, potential risk assessments, or educational information provided through the Service.
• Any decisions you make regarding your health, medical treatment, medications, or lifestyle based in whole or in part on information obtained through the Service.
• Any delay in seeking professional medical care that may result from using the Service.

10.3 No Liability for AI Accuracy

We do not guarantee the accuracy, completeness, reliability, suitability, or timeliness of any AI-generated content. MyEval AI shall not be liable for any errors, omissions, inaccuracies, or misleading information produced by the AI systems used in the Service.

10.4 Limitation on Damages

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MYEVAL AI, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS SHALL NOT EXCEED THE TOTAL AMOUNT OF FEES YOU HAVE ACTUALLY PAID TO MYEVAL AI DURING THE TWELVE (12) MONTH PERIOD IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for certain types of damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless MyEval AI, its parent companies, subsidiaries, affiliates, officers, directors, employees, agents, licensors, service providers, and contractors (collectively, the "Indemnified Parties") from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your use of or access to the Service.
• Your violation of these Terms or any applicable law or regulation.
• Your violation of any third-party right, including any intellectual property, privacy, or proprietary right.
• Any health-related decisions you make based on information obtained through the Service.
• Any content you submit to or transmit through the Service.
• Any claim by a third party related to your use of the Service.

We reserve the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify us, and you agree to cooperate with our defense of such claims. You agree not to settle any such matter without our prior written consent.

12. International Users

The Service is available to users in multiple countries and jurisdictions. If you access the Service from outside the United States, you do so on your own initiative and are solely responsible for compliance with all applicable local, national, and international laws and regulations in your jurisdiction, including but not limited to data protection laws, consumer protection laws, health information regulations, and export control laws.

You acknowledge that:

• The laws of your country or jurisdiction may apply to your use of the Service in addition to these Terms. In the event of a conflict between these Terms and mandatory local laws that cannot be waived by agreement, the mandatory local laws shall prevail to the extent of such conflict.
• Health information regulations, medical device classifications, and AI governance frameworks vary by jurisdiction. The Service may not comply with all local health information or medical device regulations in every jurisdiction. It is your responsibility to determine whether your use of the Service is lawful in your jurisdiction.
• If you are a consumer in the European Economic Area (EEA), United Kingdom, or other jurisdictions with mandatory consumer protection laws, nothing in these Terms limits your statutory consumer rights that cannot be waived or limited by contract.
• Data transfers: Your data may be transferred to, stored, and processed in the United States or other countries. By using the Service, you consent to such transfers as described in our Privacy Policy.

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms and any disputes arising out of or related to these Terms or the Service shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to its conflict of law provisions. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.

13.2 Binding Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

You and MyEval AI agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service (collectively, "Disputes") shall be resolved through binding individual arbitration, rather than in court, except as set forth below. Arbitration shall be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules then in effect, which are available at www.adr.org. The arbitration shall be conducted by a single arbitrator and shall take place in Wilmington, Delaware, unless you and we agree otherwise or the arbitrator determines that an in-person hearing is not necessary.

13.3 Arbitration Opt-Out

You have the right to opt out of binding arbitration within 30 days of the date you first accept these Terms by sending written notice of your decision to opt out to legal@myeval.ai with the subject line "Arbitration Opt-Out." Your notice must include your full name, account email address, and a clear statement that you wish to opt out of binding arbitration. If you opt out, you and MyEval AI agree to resolve Disputes exclusively in the state or federal courts located in Wilmington, Delaware, and you consent to personal jurisdiction in such courts.

13.4 Small Claims Exception

Notwithstanding the above, either party may bring an individual action in small claims court for Disputes that are within the scope of such court's jurisdiction, provided the action is brought and maintained on an individual (non-class, non-representative) basis.

13.5 Class Action Waiver

YOU AND MYEVAL AI AGREE THAT EACH OF US MAY BRING CLAIMS AGAINST THE OTHER ONLY ON AN INDIVIDUAL BASIS AND NOT AS PART OF ANY CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Unless both you and we agree otherwise in writing, the arbitrator may not consolidate or join more than one person's claims and may not preside over any form of a consolidated, representative, or class proceeding.

14. Changes to Terms

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make material changes to these Terms, we will:

• Provide at least 30 days' advance notice before the changes take effect, delivered via email to the address associated with your account and/or through a prominent notice within the Service.
• Update the "Last updated" date at the top of this page to reflect the date of the most recent revision.
• Post the revised Terms on this page so that you can review the changes.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the modified Terms, you must stop using the Service and, if applicable, cancel your subscription before the changes take effect. We encourage you to review these Terms periodically for any updates.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction or arbitrator, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect. To the extent permitted by applicable law, the invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the parties. If such modification is not possible, the invalid provision shall be deemed severed from these Terms.

The failure of MyEval AI to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by MyEval AI.
